Assessing and deciding IR35 status remains the responsibility of the contractor in certain circumstances.
The system generates a downloadable document showing the IR35 status opinion, along with in-depth reasoning. This can be used as evidence to prove IR35 status if HMRC come knocking, to compare to an external SDS, or just for curiosity.
The small business exemption means that contractors can still assess and decide their own IR35 status.
Not only that, it can be used as a learning tool to help understand IR35, used to compare and contrast to other providers, and to show HRMC via solid evidence that consideration and reasonable care has been applied when assessing IR35 status.
